BLACK SHEEP COFFEE ONLINE GIFT CARD TERMS AND CONDITIONS
These terms and conditions apply to all Black Sheep Coffee Online Gift Cards that are purchased from us. They govern the relationship between Black Sheep Coffee (“we” or “us”), you, the purchaser of the Black Sheep Coffee Online Gift Card and any person on whose behalf you purchase a Black Sheep Coffee Online Gift Card or to whom you transfer your Black Sheep Coffee Online Gift Online Card as permitted by these Terms and Conditions.
These Terms and Conditions override any statements on the Black Sheep Coffee Online Gift Card if they are different. You must therefore read them carefully. If there is anything you do not understand, please contact orders@leavetheherdbehind.com
Purchasing a Black Sheep Coffee Online Gift Card
The minimum amount required to activate a card is £10 and you are solely responsible for the amount that you place on the Black Sheep Coffee Online Gift Card.
All Black Sheep Coffee Online Gift Cards are issued by, and remain the property of, Black Sheep Coffee, 81 Southwark Street, London, SE1 0HX.
Using a Black Sheep Coffee Online Gift Card
You may give any Black Sheep Coffee Online Gift Card that you purchase from us to any third party, who may use them in accordance with these Terms and Conditions. You may not sell a Black Sheep Coffee Online Gift Card or use a Black Sheep Coffee Online Gift Card in any sales or promotional activities including as give aways or prizes in competitions without our prior written consent.
You are responsible for ensuring that any person to whom you transfer a Black Sheep Coffee Online Gift Card is made aware of these Terms and Conditions and complies with them.
Black Sheep Coffee Online Gift Cards can only be used online and is not redeemable at any Black Sheep Coffee outlet.
When the online gift card is used the amount of the purchase will be deducted from the balance on the card. The remaining balance may be applied to future purchases.
You will be required to top up any outstanding money owed to online purchases that are not covered by the balance on the online gift card.
The Black Sheep Coffee Online Gift Card is not a credit card, charge card or debit card. Black Sheep Coffee Online Gift Cards cannot be exchanged for cash. Refunds will not be given for the purchase of a Black Sheep Coffee Online Gift Card.
A balance from a Black Sheep Coffee Online Gift Card cannot be transferred to a physical Black Sheep Coffee Online Gift Card and a balance on a physical Black Sheep Coffee Online Gift Card cannot be transferred to a Black Sheep Coffee Online Gift Card.
Purchasing a Black Sheep Coffee Online Gift Card and Balance
Black Sheep Coffee Online Gift Cards can only be purchased through the Black Sheep Coffee e-commerce platform. The amount assigned to the card is selected by you at the point of order. It is important that you retain the purchase receipt to prove the Black Sheep Coffee Online Gift Card has been purchased in accordance with the above condition and to verify the amount purchased.
The balance on the card is available when making a purchase, and is shown on the original gift card email received by clicking on “View your gift card”, or simply entering the code at checkout and will add any balance remaining against the order.
When purchasing a Black Sheep Coffee Online Gift Card, you will have the opportunity to send to someone as a gift by forwarding the email with a personalised message to the recipient.
We take no liability for messages that is or is likely to be considered by any person to be defamatory, offensive, obscene, abusive, hateful, threatening, discriminatory, inflammatory, harmful, sexually explicit, deceptive, fraudulent, infringing of intellectual property rights or in any way unlawful.
Delivery of Online Gift Cards
Black Sheep Coffee Online Gift Cards shall be sent to your email address on your account after you have placed your order.
You are solely responsible for accuracy of the information provided by you when you place your order and we have no liability to you in the event that your Gift Card is delivered to the incorrect email address.
We have no liability to you for the late or non-delivery of any Black Sheep Coffee Online Gift Card in circumstances where the late or non-delivery of the Online Gift Card arises from an interruption to or failure of your computer equipment (or any other electronic device), your internet connection or your ability to receive emails.
Returning Purchases made on your Online Gift Card
If you use a Black Sheep Coffee Online Gift Card to purchase goods online and you subsequently return the goods, any refund due to you will be made back onto the original Online Gift Card.
Expiration and Cancellation
The Black Sheep Coffee Online Gift Card and balance on it will expire if the card is not used for 12 consecutive months. We reserve the right to cancel any Black Sheep Coffee Online Gift Cards if we suspect it is being used fraudulently or in breach of the Terms and Conditions. Please note, if you received your Black Sheep Coffee Online Gift Card through a campaign or promotion expiry dates may vary.
Loss, Theft, Damage
Black Sheep Coffee Online Gift Cards should be treated like cash. Black Sheep Coffee is not responsible for lost or stolen cards. Any loss, theft, fraudulent or unauthorised use of a Black Sheep Coffee Online Gift Card should be reported immediately to Black Sheep Coffee. If a Black Sheep Coffee Online Gift Card is lost, stolen, damaged or malfunctions, we may, at our discretion, replace that Black Sheep Coffee Online Gift Card and transfer the balance stored on it to a replacement Online Gift Card. Circumstances in which we may determine not to replace a Black Sheep Coffee Online Gift Card include where we reasonably believe that the notified incident has been caused by a breach of these Terms and Conditions or where there are reasonable grounds for suspecting that the cardholder is or has been engaged in fraudulent or other unlawful conduct.
If we agree to replace a Black Sheep Coffee Online Gift Card, a replacement card will be delivered to the original email delivery address, unless instruction is given by the customer that placed the original order, to send it to a different one.
If a Black Sheep Coffee Online Gift Card that has been reported lost or stolen is subsequently found or retrieved, Black Sheep Coffee Customer Services should be notified immediately.
Resale/Use in Promotions
Black Sheep Coffee Online Gift Card may not be sold without Black Sheep Coffee’s prior written consent. Black Sheep Coffee Online Gift Cards may not be in sales or promotional activities including as give away or prizes in competitions without prior written consent of Black Sheep Coffee. Black Sheep Coffee reserves the right to cancel any Black Sheep Coffee Online Gift Card that it suspects has been resold or obtained in connection with an unauthorised or promotional activity.

Data Protection and Privacy
When purchasing your Black Sheep Coffee Online Gift Card through the Black Sheep Coffee e-commerce platform, we will require certain personal information, including the name, address and contact details of the cardholder. We are committed to maintaining the security of such personal information in accordance with the requirements of the Data Protection Act and will take all reasonable steps to ensure that such personal data is kept secure against unauthorised access, loss, disclosure or destruction. The Black Sheep Coffee Privacy Policy (available at orders@leavetheherdbehind.com. com) will apply to any personal information provided to us and is incorporated by reference into these Terms and Conditions.
Liability or Black Sheep Coffee Limited
Black Sheep Coffee shall not be liable for any loss or damage arising from or in connection with the use of a Black Sheep Coffee Online Gift Card where such loss or damage arises from any cause beyond our reasonable control. Where any loss or damage arises from a cause within our control, our liability to you shall not exceed a sum equal to the balance on the relevant card as at the date that such loss or damage occurs. This clause shall not exclude or limit any liability that cannot be excluded or limited by law.
Variation
We reserve the right to amend or waive any provision of these Terms and Conditions from time to time or to terminate the Black Sheep Coffee service on reasonable notice.
The Terms and Conditions applicable to the use of a Black Sheep Coffee Online Gift Card shall at any time be the Terms and Conditions published on the Black Sheep Coffee website. Continued use of a Black Sheep Coffee Online Gift card will constitute acceptance of such terms and conditions.
Governing Law
These Terms and Conditions are governed by English law.
